Digital Services Act (DSA) Article 37 Independent Audit

What the DSA requires

 

When a platform or search engine is designated as a Very Large Online Platform (VLOP) or a Very Large Online Search Engine (VLOSE), the EU Digital Services Act requires an independent yearly compliance audit. The audit evaluates whether the platform properly adheres to the due diligence and safety measures outlined in Chapter III. When completed, the results are shared with European Commission.

 
The stakes

Companies must publish their DSA audit results. Any non-compliance will be visible to customers, competitors and the media.


Non-compliance also carries fines of up to 6% of global annual turnover.

Where organizations need help

The work required for DSA compliance happens long before the audit.


Companies must gather ongoing evidence that content moderation, transparency reporting and other high-volume processes are consistently compliant. Policies are not enough, and companies cannot reconstruct evidence later. Auditors need documentation and governance that they can test directly for algorithmic systems.


All of this work requires coordination across legal, compliance, engineering and product teams. Many organizations do not have all of that evidence in one place when the auditor arrives.
