New Jersey offers voluntary disclosure program to out-of-state sellers with customer referral agreements

On Aug. 21, 2017, the New Jersey Division of Taxation announced that it is offering a limited voluntary disclosure program until Nov. 21, 2017, to help certain out-of-state businesses comply with the sales and use tax click-through nexus (customer referral agreement) provisions that went into effect in 2014. This initiative is being offered by the division in addition to New Jersey’s participation in the voluntary disclosure program which is currently being conducted by the Multistate Tax Commission for certain online marketplace sellers.
