Oregon Tax Court makes unitary business determination

The Oregon Tax Court has determined that a rent-to-own retailer and its operating subsidiary engaged in the same line of business did not share centralized management, and accordingly were not considered to be unitary for Oregon corporation excise tax purposes. The Court also found that the subsidiary franchisor lacked Oregon corporation excise tax nexus and a wholly owned captive insurance company was unitary with the retailer.
