How do you prove HIPAA compliance?

This webcast was presented July 13, 2010, by Partner Brett Williams and Director Cindy Davis from Grant Thornton LLP Advisory Services, along with Partners Michele Madison and Sandra Gardiner from Morris Manning & Martin, LLP.

Currently, there is no official definition provided by the Department of Health and Human Services of what formal HIPAA "certification" looks like for health care providers or their business associates. So while you may be expending time and resources to comply with the new regulations, it's a struggle to get any independent confirmation to verify your efforts or help protect you from future penalties. Furthermore, with the enactment of the Health Information Technology for Economic and Clinical Health Act (HITECH Act) and the requirement of third-party service providers to comply with HIPAA security rules, these organizations now face the need to demonstrate to regulators and customers that they are complying with the regulations.

Health care providers: In this webcast, HIPAA advisors from Morris Manning & Martin LLP provided an overview of the regulatory changes and potential penalties. Then Grant Thornton explained how a HIPAA Third-Party Attestation Report of your business associates' state of compliance will give you confidence that your vendors are HIPAA compliant. Learning objectives included:

  • How a HIPAA Third-Party Attestation Report may lessen your risk of penalties
  • What information around HIPAA certification a report should contain
  • How to read the report and understand the assertion

Third-party service organizations: You need to demonstrate HIPAA compliance so your customers are comfortable that you are meeting your HIPAA obligations. The HIPAA Third-Party Attestation Report is specifically created to incorporate the most important requirements around the Act. Learning objectives included:

  • How the report allows you to display compliance as confirmed by an independent accounting firm
  • The thorniest areas that usually require the most focus and effort
  • The typical timeline for obtaining a report
  • How this report can build trust between you and your customers and potentially establish yourself as a market leader
